Process
The process of obtaining full residency in New Zealand involves two stages, each requiring a distinct kind of visa:
Resident Visa
You are able to live and work in New Zealand for an infinite period of time with a resident visa. However, a resident visa is issued with travel conditions that only allow you to leave and enter New Zealand as a resident up to a specific date. Unless your resident visa's terms (or "travel conditions") permit it, you will be refused to re-enter NZ on it.
- A New Zealand Resident Visa may be applied if:
- You are from outside of New Zealand and wish to permanently relocate here,
- You are in New Zealand on a temporary visa (but not if you have only a Limited Visa or Interim Visa).
Permanent Resident Visa
The major feature of a New Zealand permanent resident visa is it does not have any travel conditions imposed. Also it does not expire without needing to meet residency requirements in New Zealand to retain the visa so you can also leave and come back to New Zealand whenever you choose.
Resident and even permanent resident visas could still be revoked under certain conditions and you may be deported from New Zealand.
You may be able apply for a change to your travel conditions, which will give you extra time to re-enter New Zealand as a resident, if you desire to go beyond the travel restrictions set forth in your Resident Visa but are not yet eligible for a Permanent Resident Visa.
If your resident visa expires, you might be eligible for a subsequent resident visa to regain your resident visa.
Partner of a New Zealander Resident Visa
Apply in New Zealand or elsewhere
Some people call it New Zealand Spouse Visa but in fact, an unmarried partner could also be granted a partner of a New Zealander Resident Visa.
Applicants must be either of them to be eligible to apply for a New Zealand visa based on partnership with a New Zealander or resident:
- A New Zealander or NZ resident who is their de facto partner; or
- Wedded with their New Zealander or resident
New Zealand Partner Visa Rejection Cases
Even when you believe you've followed the immigration instructions, there are many reasons why your application for a Partnership Visa may still be rejected. The following are the most frequent causes of NZ partner visa rejection cases:
- Immigration NZ is not persuaded that your partner qualifies as a citizen or resident of New Zealand.
- The claim for your genuine and stable relationship is not enough for the immigration officer to be satisfied.
- Your relationship has not lasted the required amount of time, according to the immigration officer.
- You or your spouse are already legally wed or in a civil union with someone else.
- You don't meet the requirements for character or health.
Immigration NZ needs more information about your relationship than is contained in a simple marriage certificate. You will be required to submit a variety of documents, including utility bills, pictures, letters, and other paperwork. Usually, the processing time for a Partner of New Zealander Resident visa depends on whether your claim for a genuine and stable relationship is credible and backed up with persuasive evidence. Even a piece of evidence or information could get your application declined (in that case, you could appeal to the Immigration and Protection Tribunal.
